What the Texas Small Claims Limit Means for Your Case
In Texas, small claims cases are heard in justice courts. Each county is split into precincts, and a justice of the peace runs each court. People use it to get money back or to recover personal property, and the rules are kept simple for people who come without a lawyer (Tex. R. Civ. P. 500–507).
In most cases a lawyer is optional, and the judge may question witnesses to get to the facts (Rule 500.6).

Owed more than the small claims limit, or can’t collect what you won?
Larger claims go to regular civil court, and collecting a judgment has its own steps in Texas. A collections attorney can explain your options, usually in a free first consultation. Every state bar runs a lawyer-referral service that sets up a low-cost first consultation; legal aid represents many people in debt cases at no cost.
Before You File: Demand Letters and the Texas Small Claims Limit
Many people send a written demand first. It says what is owed and gives a deadline, and it also becomes evidence. Collect contracts, receipts, photos, texts and repair estimates. File in the county and precinct where the defendant lives, or in another place the rules allow, such as where the contract was to be performed or where the damage happened (Rule 502.4).
A filing in the wrong place can be moved to another court, and you may have to pay the fees again. A claim generally cannot be split into smaller cases to stay under the limit.
How to File Under the Texas Small Claims Limit
1) Fill out the statewide Small Claims Petition, available from TexasCourtHelp.gov or the court clerk (Rule 502.2). 2) File it with the justice court clerk in the right precinct, and give the defendant’s address so they can be served. 3) If you cannot afford the costs, file a sworn Statement of Inability to Afford Payment of Court Costs.
The defendant may challenge it within 7 days after their answer is due (Rule 502.3). 4) Once the defendant answers, the court sets a trial date and sends notice.
The Hearing in the Texas Small Claims Case
Bring every document, photo and receipt, with copies for the judge and the other side. Bring witnesses too, or ask the court for a subpoena. Most hearings take less than an hour. Either side may ask for a jury at least 3 days before trial and pay the jury fee (Rule 504.1). Pretrial discovery only happens if the judge approves it (Rule 500.9).
The judge usually decides at the hearing or shortly after, and signs a written judgment.
Collecting After You Win Under the Texas Small Claims Limit
Ask the other side in writing to pay. If they do not, you may get an abstract of judgment from the clerk and record it with the county clerk. That creates a lien on the debtor’s non-homestead real estate in that county (Tex. Prop. Code 52.001). After the appeal period ends, you may ask for a writ of execution. A constable then seizes and sells non-exempt property.
A bank account may be garnished through a separate case filed in the court that issued the judgment. Post-judgment discovery allows the debtor at least 30 days to respond (Rule 500.9(b)).

Appeals and the Texas Small Claims Limit
Either side may appeal. File an appeal bond, a cash deposit or a Statement of Inability within 21 days after the judgment is signed, or within 21 days after a motion for new trial is denied (Rule 506.1). A motion for new trial must be filed within 14 days after the judgment is signed (Rule 505.3).
The case is heard again from scratch (“trial de novo”) in county court or a county court at law, and the justice court judgment is no longer valid (Rule 506.3). Confirm the bond amount with the clerk.
Common Mistakes With Texas small claims limit
The most common mistake is missing a deadline: court and creditor deadlines run whether or not you have read the papers, and a missed one usually cannot be undone. The second is relying on an old article or a friend’s experience in another state — the rules on this page differ from state to state and change often, which is why every figure here is dated.
The third is not keeping copies: every letter, form, receipt and bank statement may matter later, so keep them together and note the date you received each one.

How We Verify the Texas small claims limit Figures
Every figure in the table above comes from our 50-state data file, built by reading the Texas statute or an official compilation of it, and each one carries the month we last checked it. Our writers do not change those figures; they explain them. When the law changes, the figure is updated and the date moves.
If something on this page no longer matches the statute, the statute controls — and we want to hear about it.
Texas protects current wages more strongly than most states. Under Tex. Const. art. XVI, §28, current wages generally cannot be garnished for ordinary consumer debts. The main exceptions are child support, spousal maintenance and certain government debts. Homesteads are exempt under Tex. Prop. Code ch. 41, and personal property is exempt up to set limits under Tex. Prop. Code ch. 42.
Since May 1, 2022, a debtor can claim that money targeted in a garnishment is exempt (Tex. R. Civ. P. 663a). Confirm with the statute, the court clerk or an attorney.
