What the Nebraska Maximum Interest Rate Means
Usury means charging more interest than Nebraska law allows. The legal rate is a fallback that applies only when a loan or debt never set a rate. The contract cap is the most a lender can charge when the borrower agrees to a rate in writing. Confirm details with the statute or an attorney.

Who the Nebraska Maximum Interest Rate Applies To
The cap mainly protects individual consumer borrowers. Under Neb. Rev. Stat. 45-101.04, loans to corporations, partnerships, LLCs and trusts (and anyone guaranteeing those loans) are exempt. Since July 18, 2026 (LB 717), loans totaling $100,000 or more from one lender are also exempt; before that the cutoff was $25,000. Banks chartered in other states and lenders licensed under Nebraska’s Installment Loan Act follow separate rate rules, not this cap.
Credit Cards and the Nebraska Maximum Interest Rate
Most credit cards come from national banks. Federal law (12 U.S.C. 85) lets a national bank charge the rate allowed in its home state to borrowers in any state. A card from a bank based in a state with high or no rate limits can therefore legally charge a Nebraska cardholder more than the Nebraska cap.
What Happens When a Lender Breaks the Nebraska Maximum Interest Rate
Under Neb. Rev. Stat. 45-105, a lender whose contract breaks the cap can in most cases recover only the principal, and loses all interest. Under 45-110, recovery is limited to the amount originally contracted for plus interest up to the legal maximum, plus costs. Payday loans made above the 36% APR cap are void, and the lender cannot collect or keep the principal, interest or fees.
No separate criminal usury threshold was found in Chapter 45; confirm with an attorney.
How to Check a Loan Against the Nebraska Maximum Interest Rate
1) Find the APR on the Truth in Lending disclosure in the loan papers. 2) Check whether the lender is a bank, a licensed installment lender, a payday lender, or a private person or business. 3) Check whether the loan is exempt (a business borrower, or $100,000 or more). 4) If none of the exemptions fit, compare the APR with the written-contract cap.
5) Confirm with the Department of Banking and Finance or an attorney.
Where to Report a Loan Above the Nebraska Maximum Interest Rate

How We Verify the Nebraska maximum interest rate Figures
Every figure in the table above comes from our 50-state data file, built by reading the Nebraska statute or an official compilation of it, and each one carries the month we last checked it. Our writers do not change those figures; they explain them. When the law changes, the figure is updated and the date moves.
If something on this page no longer matches the statute, the statute controls — and we want to hear about it.
Payday lenders (called “delayed deposit services licensees”) cannot charge more than a 36% APR. Voters set this limit by passing Initiative 428 on November 3, 2020; it replaced the old $15-per-$100 fee limit. Separately, LB 717, signed February 25, 2026, raised the usury exemption from $25,000 to $100,000; the statute page lists July 18, 2026 as the operative date.
Next rung: the Nebraska payday loan page covers the short-term loans that have their own caps.
